Purchase Terms & Conditions
1. Definitions
- “Tiny Build Electrics” refers to Tiny Build Electrics Ltd, a company registered in England and Wales.
- “Customer” refers to the individual or entity purchasing goods or services from Tiny Build Electrics.
- “Goods” refers to any products sold by Tiny Build Electrics.
- “Services” refers to any services provided by Tiny Build Electrics.
- “Contract” refers to the agreement between Tiny Build Electrics and the Customer for the supply of Goods or Services.
2. Goods
- 2.1 Conformity with Description: All Goods will conform to their description on the Tiny Build Electrics website or as otherwise agreed in writing.
- 2.2 Satisfactory Quality: All Goods will be of satisfactory quality. Any description of the Goods on the Tiny Build Electrics website (including any images, specifications, or details) is for illustrative purposes only and does not constitute a warranty or guarantee of the Goods’ quality or performance.
- 2.3 Fitness for Purpose: The Customer is responsible for ensuring that the Goods are fit for their intended purpose. Tiny Build Electrics makes no warranty or representation that the Goods are fit for any particular purpose, even if that purpose has been made known to Tiny Build Electrics.
3. Services
- 3.1 Reasonable Care and Skill: All Services will be provided with reasonable care and skill.
- 3.2 Compliance with Standards: Tiny Build Electrics will use reasonable endeavors to provide Services in compliance with relevant industry standards and regulations. However, the Customer acknowledges that compliance with specific standards and regulations is ultimately their responsibility.
4. Delivery
- 4.1 Delivery Location: Goods will be delivered to the address specified by the Customer.
- 4.2 Delivery Time: Tiny Build Electrics will make reasonable endeavors to deliver the Goods to the Customer within 30 days of the date of the Contract. However, Tiny Build Electrics does not guarantee delivery within this timeframe.
Unforeseen circumstances, such as backorder delays with our suppliers or other factors outside of Tiny Build Electrics’ control, may result in delivery exceeding the 30-day period. Tiny Build Electrics will not be liable for any loss or damage suffered by the Customer due to such delays.
Time of delivery is not of the essence of this Contract.
- 4.3 Delivery Charges: Delivery charges will be as stated on the Tiny Build Electrics website or as otherwise agreed in writing.
- 4.4 Risk of Loss: Risk of loss or damage to the Goods passes to the Customer upon delivery.
- 4.5 Delivery Delays: Tiny Build Electrics will not be liable for any losses or damages arising from delays in delivery, regardless of the cause of the delay.
5. Returns
- 5.1 Right to Cancel: The Customer may cancel their order for Goods at any time before the Goods have been dispatched.
- 5.2 Faulty Goods: If the Customer believes Goods are faulty, they must notify Tiny Build Electrics within 48 hours of delivery. The Goods must be returned to Tiny Build Electrics for inspection. If a fault is confirmed and is not due to misuse or incorrect installation by the Customer, Tiny Build Electrics will, at its discretion, repair or replace the Goods or provide a refund.
- 5.3 Non-Faulty Goods: Non-faulty Goods may be returned within 14 days of delivery for a refund, at the sole discretion of Tiny Build Electrics. The Goods must be in their original condition and packaging, and the Customer is responsible for return shipping costs.
- 5.4 Custom Items: Custom-cut items, such as cables, are non-returnable and non-refundable.
6. Warranty
- 6.1 Manufacturer’s Warranty: Goods may be covered by the manufacturer’s warranty, where applicable. Tiny Build Electrics will assist the Customer with making a warranty claim, but the final decision on any warranty claim rests with the manufacturer.
7. Limitation of Liability
- 7.1 Indirect Losses: Tiny Build Electrics will not be liable for any indirect or consequential losses arising from the supply of Goods or Services, including but not limited to loss of profits, loss of business, or loss of data.
- 7.2 Third-Party Components: Tiny Build Electrics will not be liable for any issues arising from components supplied by the Customer or third parties.
- 7.3 Installation: The Customer is responsible for the correct installation and use of Goods. Tiny Build Electrics will not be liable for any damage, loss, or injury arising from incorrect installation or use of Goods.
- 7.4 Force Majeure: Tiny Build Electrics will not be liable for any delay or failure to perform its obligations under this Contract due to any cause beyond its reasonable control, including but not limited to acts of God, war, terrorism, strikes, lockouts, or pandemics.
8. General
- 8.1 Entire Agreement: These Terms and Conditions constitute the entire agreement between Tiny Build Electrics and the Customer.
- 8.2 Governing Law: This Contract is governed by the laws of England and Wales.
- 8.3 Severability: If any provision of these Terms and Conditions is held to be invalid or unenforceable, that provision shall be struck out and the remaining provisions shall remain in force.
